Michigan is a Stand Your Ground state, therefore it should be quite obvious that you have the right to defend yourself and your family against a threat on your safety, especially if that threat comes on private property. However, this apparently will not be the case for young Siwatu-Salama Ra after an incident at her mother’s Detroit home.
The incident that we’re speaking of took place nearly a year ago in July 2017, but the court battle has just finished and the results are quite sad for Ra and legal gun owners everywhere in the state.
But first, let’s go back to July 2017. The confrontation took place in front of Ra’s mother’s house which is located on Sturtevant Street in Detroit. According to reports, it occurred because of a fight that took place a few months earlier between Ra’s niece and a friend of the said niece.
But tempers did not cool in the months in between and eventually, a verbal confrontation occurred between Ra and her niece’s friend’s mother, Chanell Harvey, who had driven to the home to pick up her daughter. The situation then escalated quickly, according to reports. Chanell Harvey used her car to violently ram Ra’s vehicle while Ra’s 2-year-old daughter was inside the house, playing. Harvey then allegedly tried to run over Ra’s mother, who was on her front porch at the time.
This chaos had to stop and Ra figured she knew how to do it, by grabbing her registered, unloaded handgun from her car’s glovebox. Ra then pointed the gun at Harvey’s car in an attempt to deter her from attacking again. This did stop Harvey from ramming once more, but instead of heading for the hills, Harvey pulled out her cell phone and snapped three photos of Ra holding the gun. Harvey then went to the police and reported that she was confronted by a hostile and gun-wielding Ra.
Ra did not immediately go to the police herself so her word was not as well-received by the Detroit police. A legal battle then ensued which found that even though Ra’s firearm was legally purchased, legally carried, and she had the right to defend her and her family’s safety due to the Stand Your Ground Law that Michigan has, Siwatu-Salama Ra will be going to jail for a minimum of 2 years.
And to make matters worse, Ra is currently with child and will be forced to give birth behind the walls of a jail.
This incident is a sad case of someone not following procedure to make sure that the legal ramifications of their defensive gun use are handled in the best way possible. Just because your chaotic conundrum is over does not mean that you are ready to just go back to normal life. We will never know what would have happened if Siwatu had called the police first, but we do know what happened when she didn’t at all.
This is not to say, of course, that there are no other issues with regard to this case that many people are calling an injustice, but with what we know the best that we can offer is a bit of advice about what to do after you have used your gun. We hope that you never have to go through an incident like this and we hope for nothing but the best for Siwatu and her family in the trying months and years ahead.
